1. About these terms
These Terms & Conditions ("Terms") govern your use of the Site, which presents Místico, a residential and hospitality community in Playa Hermosa, Puntarenas, Costa Rica. The Site is operated by [LEGAL ENTITY NAME], corporate ID (cédula jurídica) [3-XXX-XXXXXX], with offices at [Momentum Lindora, 3rd floor, Santa Ana, San José, Costa Rica] ("Místico", "we", "us" or "our").
By using the Site you accept these Terms and our Privacy Policy. If you do not accept them, please do not use the Site.
Language. These Terms are published in Spanish and English. [If the two versions differ, the Spanish version prevails.]
Your rights as a consumer. Nothing in these Terms limits the rights you have under Costa Rica's Law No. 7472 on the Promotion of Competition and Effective Consumer Protection, or under any other law that cannot be waived by contract.
2. What the Site is for
The Site gives general information about Místico's neighborhoods, projects, homes, lots, amenities, hotel, restaurants and activities, and lets you contact our sales team.
The Site does not sell property. You cannot reserve or buy a property through the Site. A reservation or purchase exists only when you and we sign a written reservation agreement, promise of sale or deed, and its terms will govern the transaction.
3. Property information
We work to keep the Site accurate and up to date. Even so, please note:
3.1 Images and plans. Renderings, illustrations, 3D views, master plans, site plans, floor plans, videos and photos of model homes are for illustration. They may show furniture, finishes, landscaping, views, neighbouring buildings or amenities that are not included, not yet built, or different in the final project. Photos of the area may have been taken at different times.
3.2 Sizes and measurements. Areas, lot sizes, distances and dimensions are approximate. The binding measurements are those in the registered cadastral plan (plano catastrado) and in your signed contract. Values in imperial units (ft², acres, miles, °F) are converted automatically from metric values and rounded. The metric values prevail.
3.3 Prices. Unless a contract says otherwise:
- prices are in United States dollars;
- prices shown as "from" refer to the lowest-priced unit available in that project at the time of publication;
- prices do not include transfer tax, registration fees and stamps, notary fees, value added tax where applicable, owners' association fees, insurance, furniture, or financing costs, which will be detailed in your quote and contract;
- prices may change without notice until you sign a reservation agreement.
When we publish an offer or promotion, we will state its conditions, restrictions and how long it is valid.
3.4 Availability. Unit status (available, reserved, sold) is updated automatically from our sales system, but there may be a delay. A unit is only held for you once a reservation agreement is signed and, where it requires one, the deposit is received.
3.5 Amenities, future phases and timelines. Amenities, infrastructure, future neighborhoods and projects marked "Coming soon", "Pre-sale" or "Future zone", and delivery dates, depend on permits, construction and market conditions and may change, be delayed or not be built. The specific amenities, specifications and delivery dates you buy are those set out in your contract.
3.6 If the contract is more favourable. If your signed contract contains conditions that are more favourable to you than the information on the Site, the contract prevails, as provided by article 37 of Law 7472.
4. Reservations, purchases and deposits
- Reservations and purchases are made only with our sales team, through written agreements signed by both parties.
- Deposits and advance payments are handled as set out in the signed agreement and in the regulations on the sale of real estate projects for future delivery issued by the Ministry of Economy, Industry and Commerce (MEIC). [Confirm deposit custody arrangements: trust/escrow entity.]
- Before signing, we must verify your identity and the origin of the funds, as required by anti-money-laundering law (Law No. 7786 and its regulations). We may refuse or cancel a transaction if these checks cannot be completed.
- Some projects are sold as condominiums or within a residential community, and owners must follow their bylaws, rules and fees. Copies are available from our sales team on request.
5. No professional advice
Information on the Site is general and is not legal, tax, financial, immigration or investment advice. Before buying, we recommend that you get independent advice, especially if you are not a Costa Rican resident.
In particular, we do not promise:
- any appreciation in the value of a property;
- any rental income or occupancy rate, unless set out in a separate signed rental agreement;
- that buying a property will give you a right to residency in Costa Rica, as residency depends on the immigration authorities.
6. Beaches and the maritime-terrestrial zone
All beaches in Costa Rica are public. Under Law No. 6043 on the Maritime-Terrestrial Zone, the first 50 metres from the high-tide line are public and open to everyone, and the next 150 metres are a restricted zone that can only be used through government concessions. Words such as "beachfront", "oceanfront" and "on the beach" describe a property's location near the coast. They do not mean that any part of the beach is private or reserved for Místico owners. The legal status of each lot (titled property or concession) will be set out in its contract and registry records.
7. Hotel, restaurants, activities and other operators
The Site presents Amarena Canvas Beach Hotel, Madresal Beach Club, restaurants, the Adventure Center and other services in and around Místico. [Some of these are operated by other companies.] Opening hours, menus, prices, activities and access conditions may change. Please confirm them with the operator before you go.
When you book a room, table, activity or service, you contract with the operator under its own terms. Outdoor and water activities such as surfing, horse riding and tours carry risks. Follow the operator's safety instructions and the conditions of the sea. Access to some amenities, such as the beach club, may be reserved for owners and their guests and subject to separate rules.
8. Your enquiries
When you send a form or contact us:
- give true, current and complete information and use only your own contact details, or details you are authorised to share;
- if you are a real estate agent, say so in the form. Commissions are only payable under a separate written agreement with us;
- our sales team will contact you by email, phone or WhatsApp to answer your enquiry. Marketing messages are only sent if you opt in, as explained in the Privacy Policy.
9. Using the Site
You may use the Site for personal, non-commercial purposes. You must not:
- copy, scrape or extract content, prices or availability data in bulk, including with bots or automated tools;
- send spam, false enquiries or harmful code, or try to get around the Site's security or spam protection;
- use the Site in a way that breaks the law or infringes the rights of others;
- present yourself as Místico, our staff or our agents, or use our name or brand without permission.
We may suspend access to the Site, or to its forms, for anyone who breaks these rules.
10. Intellectual property
The Místico name, logos, wordmark and patterns, and the texts, photos, renderings, videos, illustrations, maps, icons, designs and code of the Site, belong to us or to our licensors and are protected by intellectual property law. You may view them and share links to the Site. You may not copy, modify, publish or use them commercially without our written permission.
The brochure and other downloadable files are for your personal use while you consider a purchase.
11. Links and third-party services
The Site links to and uses services run by others, such as WhatsApp, Google Maps, Waze, Windy, video players and the websites of operators mentioned in section 7. We do not control them and are not responsible for their content, availability or privacy practices.
Weather, sea and surf conditions shown on the Site come from external sources, are approximate and must not be relied on for safety decisions.
12. Availability of the Site
We may change, update or remove parts of the Site at any time. We do not guarantee that the Site will always be available or free of errors or viruses, and we will fix errors as soon as we reasonably can once we know about them.
13. Liability
To the extent permitted by law, we are not responsible for:
- decisions you make based only on the general information on the Site, without checking the binding terms of a signed contract;
- interruptions, errors or delays in the Site caused by events outside our reasonable control;
- the content and services of third parties described in sections 7 and 11.
Nothing in these Terms excludes or limits our liability for death or personal injury, for fraud, for wilful misconduct or gross negligence, for defective performance or delay in a contract with you, or for any other liability that cannot be limited under Costa Rican law, including article 42 of Law 7472.
14. Privacy
We handle your personal data as explained in our Privacy Policy and Cookie Policy.
15. Changes to these Terms
We may update these Terms when the Site or the law changes. The new version will be published on this page with a new "Last updated" date and applies from then on. Changes do not affect contracts you have already signed with us.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Costa Rica.
If you have a complaint, please write to us first at [info@misticocr.com] so we can try to resolve it. If we cannot, the competent courts of [San José], Costa Rica, will have jurisdiction. If you are a consumer, you may also file a complaint with the National Consumer Commission (Comisión Nacional del Consumidor) of the MEIC, and nothing in this section limits your right to do so or to go to the courts of your domicile where the law allows it.
17. General
- If any part of these Terms is found invalid, the rest remains in force.
- If we do not enforce a right immediately, we have not waived it.
- These Terms, together with the Privacy Policy, are the full agreement between you and us about the use of the Site. Any reservation or purchase is governed by its own signed agreements.
